2007-2008 Company Terms and Policies

GENERAL:

For purposes of this agreement, the term "The Company" is meant to represent Izzy's Custom Cages, LLC.

This document supersedes all previous company terms and policies.

Izzy's Custom Cages, LLC reserves the right to make changes to company terms and policies at any time, and without warning. Izzy's Custom Cages, LLC also reserves the right to make changes and/or modifications in pricing structure or product design at any time, and without warning.

LABOR RATE:

Our current labor rate for cage fabrication work is formula based. $45.00 per point, $25.00 per bend and $10.50 per foot of installed tubing in addition to actual material costs (tubing, gussets, plate). Estimates DO NOT include interior & dash removal, modification or reinstallation, undercoating & seam sealer removal, or painting, padding, harness, window & right side net installation. Our hourly labor rate is currently $45.00 (Forty Five U.S. Dollars) per hour for non cage fabrication work with the exception of race seat installation/fabrication. Racing seat installation/fabrication is currently $55.00 (Fifty Five U.S. Dollars).

PAYMENTS ACCEPTED:

Izzy's Custom Cages, LLC accepts the following as payment: Certified Checks, Money Orders, and Cash. Personal checks are only allowed with prior management approval, and are subject to a $25 return check fee. Collection costs and any other associated costs will be paid by the customer if a check is returned for any reason. Izzy's Custom Cages, LLC reserves the right to decline any form of accepted payment from any customer at any time, without cause or reason.

SALES AND RETURN POLICY:

ALL SALES ARE FINAL, NO RETURNS ACCEPTED

Used parts are sold as-is without any warranty of any kind, either expressed or implied. There is no guarantee made as to the condition of used parts, as many times their exact condition is unknown. Customer assumes all risks connected with the purchase, installation, and/or use of used parts sold by Izzy's Custom Cages, LLC. The company will not be held liable for any delays or damages, consequential or otherwise, incurred as a result of the sale, installation, or use of used parts.

VEHICLE REPAIR AND MODIFICATION POLICY:

Material Deposits will be required to schedule and reserve a time slot in advance for completion of invoiced work. Material Deposits do not guarantee a specific date for invoiced work to begin, however, deposits do guarantee that a time slot will be scheduled and reserved for completion of invoiced work. Material Deposit amounts are normally $250.00 but are up to the sole discretion of management. Upon drop-off, a deposit of 50% of the estimate is required before work will begin. Any estimate totaling over $4,000.00 (Four Thousand U.S. Dollars) which includes work to be performed at our facility, requires a deposit of at least 50% prepaid at the time the vehicle is delivered to our facility. Material Deposits are not refundable within 7 days of scheduled drop-off date.

Upon completion of invoiced work, all invoices must be fully paid before the vehicle is permitted to leave our premesis. When taking delivery of any vehicle upon completion of invoiced work, payments must be made in the form of certified funds or cash. Acceptance of personal checks is up to the sole discretion of management.

It is the customer's responsibility to obtain transportation to and from our facility at all times!

All parts removed from customer vehicles will be considered the property of Izzy's Custom Cages, LLC unless prior arrangements have been made with management. Any part left at our facility once the vehicle has been returned to the owner will be considered the property of Izzy's Custom Cages, LLC. It is the responsibility of each customer to arrange for the return of his/her parts before removing their vehicle from Izzy's Custom Cages, LLC facility.

PAST DUE ACCOUNTS:

INVOICED PARTS WITH LABOR:

A penalty fee of 1.7% per 30-day period (or 20.4% annually) shall be applied to all past due accounts. Past due accounts are those invoices which are not paid in full within 30 days after completion of work. This penalty fee will accrue on the full balance due until paid in full. Storage fees will also apply to any vehicles left at our facility over 30 days from the date of completion. Storage fees will total $20.00 (Twenty U.S. Dollars) per day.

NOTICE OF LEGAL DISCLAIMER:

All products (including motor vehicles) sold or installed by Izzy's Custom Cages, LLC are intended for high performance, racing, and off-road use only. Due to the nature of such parts, the unusual stresses placed upon them, and the fact that we cannot control how they are installed or used; there is no warranty of any kind on any Izzy's Custom Cages, LLC product or service. Izzy's Custom Cages, LLC expressly disclaims any warranty, either expressed or implied, including all warranties of merchantability or fitness for a particular purpose. Izzy's Custom Cages, LLC also disclaims any other obligation or liability as a result of products sold and/or installed or any service provided. No representations have been or will be made to the buyer regarding Izzy's Custom Cages, LLC products, including, but not limited to, their quality or performance. Izzy's Custom Cages, LLC shall not be held liable for any damages caused by a defect or failure of parts manufactured, sold, installed, or services performed. The company shall not be responsible for any damages, consequential or otherwise, arising from any cause whatsoever. Izzy's Custom Cages, LLC will not be responsible for labor, transportation, or any other related costs incurred as a result of any part failure or defect. If at any time Izzy's Custom Cages, LLC requires the services of an attorney in reference to the customer or activities related to the customer, whether legal action is brought or not; the customer agrees to pay all costs involved, including, but not limited to, court costs and attorney fees.

The installation of any product sold by Izzy's Custom Cages, LLC on any vehicle intended for use on public roads may violate certain U.S. and/or State laws or regulations, including those relating to motor vehicle safety and emissions standards. The purchaser assumes all risks and expenses relating to unlawful vehicle operation on public roads. Izzy's Custom Cages, LLC shall not be held liable for unlawful vehicle operation.

Agreement to Hold Harmless

Izzy's Custom Cages, LLC will not be held responsible for any damages to persons and/or property while located at our facility or while under the care or direction of authorized employees or agents of the company. Izzy's Custom Cages, LLC along with its employees or agents, will not be held liable for damages, consequential or otherwise, to vehicles left at our facility or under our care and/or operation. It is the responsibility of the customer and/or vehicle owner to maintain adequate insurance coverage while the vehicle remains at our facility or under our care. The Company is not responsible for acts of vandalism, theft, weather, fire, or any other reason that may cause damage to a customer vehicle. In the course of executing a work order, The Company may be required to test drive customer vehicles. It is the responsibility of each customer to maintain valid and current State registration and inspection documentation for the vehicle when under the care of Izzy's Custom Cages, LLC. Proof of such registration and inspection must be kept with the vehicle at all times, along with valid proof of adequate insurance coverage. The customer will be responsible for payment of any fines, fees, or legal costs incurred as a result of failure to maintain current insurance coverage, State registration, or vehicle inspections for the vehicle.

Waiver and Assumption of Risk

Each and every customer of Izzy's Custom Cages, LLC voluntarily makes and grants this waiver and assumption of risk for itself and its assigns, in favor of the company for the opportunity to utilize the facilities, equipment, materials, and any other asset of the company; and/or to engage in activities or gatherings sponsored by the company; and/or to utilize the labor and materials supplied by Izzy's Custom Cages, LLC for use in a motor vehicle. The customer will hereby waive and release any and all claims whether in contract or of personal injury, bodily injury, property damage, damages, losses, and/or death that may arise from aforementioned installation, use, or receipt. Customer understands and recognizes that there are certain risks, dangers, and perils connected with the installation and use of high performance, racing, and/or off-road parts. It is fully acknowledged that these risks are understood at the time of purchase.

All claims involving Izzy's Custom Cages, LLC are to be governed by the laws of the State of Missouri.
